Commercial property maintenance: landlord responsibilities in England

If you let commercial property, the Minimum Energy Efficiency Standards apply. Since 1 April 2023, landlords must not continue to let a non-domestic property with an EPC rating below E unless a valid exemption is registered. In June 2026 the government said it intends privately rented non-domestic buildings over 1,000 square metres to reach EPC B from 2031 where cost-effective, subject to new legislation, while smaller buildings stay at E for now. Planned maintenance is a good time to improve insulation, lighting and heating controls.

Landlords and managing agents are often the responsible person for common parts and shared areas under the Regulatory Reform (Fire Safety) Order 2005. That means keeping a fire risk assessment under review, recording it in full and maintaining fire doors, alarms and emergency lighting. In non-domestic premises, whoever is responsible for maintenance or repair may also hold the duty to manage asbestos. Keeping these records up to date and sharing them with contractors makes maintenance safer and helps work start sooner.

Regular checks help landlords meet wider duties across a portfolio. HSE expects landlords, as people in control of premises, to assess and manage the risk from legionella in water systems. Where flats sit above shops or offices, landlords must also arrange a gas safety check on each gas appliance and flue in the homes at least every 12 months, by a Gas Safe registered engineer. A planned maintenance programme helps keep these checks, and the repairs that follow, on schedule across every building you manage.
